There are three main types of patents: utility patents, design patents, and plant patents. Each type of patent protects a different kind of invention.
Utility patents are the most common type of patent. They protect new and useful processes, machines, manufactures, or compositions of matter, or new and useful improvements of existing inventions. For example, a utility patent could be granted for a new type of drug, a new manufacturing process for a product, or an improvement to an existing machine.
Design patents protect the ornamental design of an article of manufacture. This means that they protect the way an object looks, rather than how it works. For example, a design patent could be granted for the shape of a new chair, the pattern on a fabric, or the design of a new car.
Plant patents protect new and distinct varieties of plants, including asexually reproduced plants, such as cultivated sports, mutants, hybrids, and newly found seedlings, other than a tuber propagated plant or a plant found in an uncultivated state. For example, a plant patent could be granted for a new variety of rose, a new type of tomato, or a new hybrid corn plant.
In addition to these three main types of patents, there are also two other types of patents that are issued less often:
Reissue patents are issued to correct errors in already issued patents. For example, a reissue patent could be issued to correct a typo in the patent claims or to add a new claim that was not included in the original patent application.
Provisional patents are a type of patent application that allows inventors to file a patent application without having to provide all of the information that is required for a non-provisional patent application. Provisional patent applications are typically filed to establish an early filing date for an invention, which can be important if the inventor is concerned about someone else patenting the same invention.
